Following an inspection in March 2026, the FDA issued a warning letter to Binh Minh Tofu of San Jose, California, regarding serious safety and labeling violations at its food manufacturing facility. The agency determined that the company’s ready-to-eat products, including various types of tofu and soymilk, were produced under conditions that could lead to contamination or health risks, violating the Federal Food, Drug, and Cosmetic Act. Significant food safety issues included a lack of controlled cooling processes for cooked tofu, which can allow harmful bacteria to grow. Investigators also documented poor employee hygiene—such as failing to wash hands after touching dirty surfaces—and inadequate cleaning procedures that caused dirty water to splash onto food-contact equipment. Furthermore, the facility’s physical structure was found to be in disrepair, featuring cracked floors with standing water and holes in the walls. The FDA also cited the company for numerous labeling errors. These included the failure to declare artificial colors and flavors, the misleading use of the word "fresh" on processed items, and missing nutritional data. Additionally, labels failed to list all ingredients or provide required translations for products sold in multiple languages. Binh Minh Tofu is required to respond within 15 working days to provide a detailed plan for correcting these issues. This response must include scientific proof that new cooling methods are effective and photographic evidence of facility repairs. Failure to comply may lead to legal actions, such as the suspension of the facility"s registration or the seizure of products.
