FDA WARNING_LETTER - Foremost Foods International, Inc./Seafood City - July 25, 2012

On July 25, 2012, the FDA inspected Foremost Foods International, Inc.'s food warehousing facility in Pomona, CA, following seafood product sample collection on May 29, 2012, and July 25, 2012, from the facility and a Seafood City Supermarket, respectively. The inspection and sample analysis revealed violations of the Federal Food, Drug, and Cosmetic Act.

Specifically, a product labeled "Basa" (Pangasius bocourti) collected from the facility was identified as Pangasius hypophthalmus, a fish of inferior value. This constitutes adulteration under section 402(b)(2) and misbranding under section 403(b) of the Act. While the firm promised corrective actions on July 3, 2012, their adequacy is unconfirmed.

Additionally, "Yellow Catfish" supplied by Foremost Foods to Seafood City Supermarket was identified as Clarias batrachus ("Walking Clarias Fish"). This product is misbranded under section 403(t) because it is not classified within the Ictaluridae family (true catfish), and under section 403(b) for being offered under an incorrect name.

The FDA also observed "Swai" products supplied by Foremost Foods being labeled as "Swai Catfish" or "Swai (Catfish)" at Seafood City Supermarket locations
