Grow God, LLC – FDA Warning Letter, Jul 16, 2024

The FDA issued a Warning Letter to GrowGod LLC after reviewing their website, growgod.org, in February and March 2024. The FDA determined that GrowGod's Medicated Funyuns – GrowGod™ Delta-8, Doritos – GrowGod™ Delta-8, Infused Gushers – GrowGod™ Delta-8, and Cheetos Flamin’ Hot Crunchy – GrowGod™ Delta-8 products are adulterated under section 402(a)(2)(C)(i) of the Federal Food, Drug, and Cosmetic Act (the Act), 21 U.S.C. 342(a)(2)(C)(i), because they contain an unsafe food additive, Delta-8 THC.

The FDA states that Delta-8 THC is not approved as a food additive and is not generally recognized as safe (GRAS). The agency expressed serious concerns about Delta-8 THC products, citing potential health risks, adverse event reports (over 300 from 2021-2023, nearly half involving hospitalization), psychoactive effects, and concerns about manufacturing processes and appeal to children. The products mimic well-known snack brands, increasing the risk of accidental consumption by children.

Introducing adulterated food into interstate commerce is a prohibited act under section 301(a) of the Act, 21 U.S.C. 331(a).
