FDA WARNING_LETTER - Nestle USA

The FDA issued a Warning Letter to Nestle regarding the labeling of several Juicy Juice products, specifically Juicy Juice Brain Development Fruit Juice Beverage (Apple), Juicy Juice All-Natural 100% Juice Orange Tangerine, and Juicy Juice All-Natural 100% Juice Grape. The FDA concluded these products are misbranded under section 403 of the Federal Food, Drug, and Cosmetic Act (the Act) [21 USC 343] due to deviations from the Act and FDA regulations at Title 21 of the Code of Federal Regulations.

For Juicy Juice Brain Development Fruit Juice Beverage, marketed for children under two, the label includes unauthorized nutrient content claims. The "no sugar added" claim is not permitted for conventional food products intended for children under age 2 (21 CFR 101.60(c)(4)). Additionally, the product's website, juicyjuice.com, makes the unauthorized claim "naturally lower in sugar," which is also not allowed for foods intended for children under age 2 (21 CFR 101.60(c)(5)).

For Nestle Juicy Juice All Natural 100% Juice Orange Tangerine and Grape products, the labels are misleading under section 403(a)(1) of the Act [21 USC 343(a)(1)]. The labeling implies the products are 100% orange/tangerine or grape juice
