The product is deemed misbranded because its labeling bears unauthorized nutrient content claims for a food intended for infants and children less than two years of age.

Specifically, the product's labeling, including the product name "Baby," statements like "traditional 'first snack' for babies," and "as soon as he or she is ready for solid food," indicates its target demographic is under two years old. Despite this, the product claims "Low in Fat" and "No Added Fats or Oils." FDA regulations (21 CFR 101.13(b)(3) and 21 CFR 101.62) prohibit such fat-related nutrient content claims for foods intended for this age group unless specifically authorized, which these claims are not.

The FDA requires prompt corrective action within 15 days, including an explanation of steps taken to correct current violations and prevent future ones, with supporting documentation. Failure to comply may result in regulatory actions, including refusal of admission of products into the U.S. under Section 801(a) of the Act, potentially leading to detention without physical examination (DWPE) and inclusion in FDA's Import Alerts, such as Import Alert #99-20.
