On February 9, 2010, the FDA issued a Warning Letter to P & D Dairy following an investigation conducted on June 29, July 1, and October 22, 2009. The investigation found that P & D Dairy offered for sale an adulterated animal for slaughter as food. Specifically, a culled dairy cow sold on May 4, 2009, and slaughtered on May 5, 2009, contained 1.177 ppm of sulfadimethoxine residue in its liver, exceeding the FDA tolerance of 0.1 ppm. This violates section 402(a)(2)(C)(ii) of the Act.
The dairy also failed to maintain complete treatment records, leading to conditions where medicated animals with potentially harmful drug residues could enter the food supply, thus adulterating food under section 402(a)(4) of the Act. Furthermore, P & D Dairy illegally used penicillin G procaine (Injectable Suspension) extralabelly on the culled cow without veterinary supervision, violating 21 C.F.R. 530.11(a) and causing the drug to be unsafe and adulterated under sections 512(a) and 501(a)(5) of the Act.
